Terms of Service

Eligibility and accounts

You must be at least 13 years old, or the age required in your jurisdiction to use the Service without parental consent, whichever is higher. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization and “you” includes that organization.

You may need an account. You agree to provide accurate information, keep credentials confidential, and promptly notify us at [email protected] if you suspect unauthorized access. You are responsible for activity under your account unless caused by our gross negligence.

The Service

AutoVisuals provides tools that help users create AI-assisted image modifications and previews (for example, vehicle-focused modification concepts). Features may change, and we may suspend or discontinue parts of the Service with or without notice.

The Service may integrate with third-party AI, infrastructure, storage, analytics, authentication, or payment providers. Your use of those integrations is subject to their terms and policies where applicable.

AI outputs and no professional advice

Outputs generated through the Service are probabilistic and may be inaccurate, incomplete, unsuitable, or inconsistent with real-world constraints (including safety, legality, and feasibility). Outputs are conceptual previews only.

The Service does not provide engineering, automotive, safety, regulatory, or legal advice. You are solely responsible for verifying whether any real-world work, purchase, or modification is appropriate, legal, safe, and warranted for your situation.

User content

You may upload, submit, or otherwise provide content through the Service, such as text prompts, images, references, or profile information (“User Content”). As between you and AutoVisuals, you retain ownership of your User Content.

You grant AutoVisuals a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and create derivative modifications solely as needed to operate, provide, secure, troubleshoot, and improve the Service for you and other users, including format conversion, resizing, and generating previews consistent with your requests.

You represent and warrant that you have all rights, consents, and permissions needed for your User Content and that your User Content does not violate applicable law or third-party rights.

Acceptable use

You will not, and will not attempt to: (a) violate any law or infringe others’ rights; (b) submit unlawful, fraudulent, harassing, hateful, sexually exploitative, violent, or otherwise harmful content; (c) attempt to probe, scan, interfere with, or overload the Service; (d) circumvent access controls, security, rate limits, or billing; (e) resell or redistribute the Service without authorization; (f) use the Service to build a competing product by extracting training sets through systematic scraping; or (g) misrepresent outputs as human-created when required by law to disclose AI-generated content.

We may investigate violations and may remove content, suspend accounts, or terminate access when we reasonably believe there is a risk of harm, abuse, or legal exposure.

Fees, credits, and payments

Certain features may require payment, credits, or subscriptions. Prices and taxes are as shown at checkout or in-product and may change. Unless stated otherwise, fees are non-refundable to the extent permitted by law.

Mobile purchases for digital credits and subscriptions are handled through Apple App Store or Google Play in-app purchase. Web purchases may use a separate web checkout. Credits are used to create AI previews and are not redeemable for cash.

If you purchase through a third-party payment processor, their terms also apply. Failures or delays caused by banks, card networks, or processors are outside our control.

Our intellectual property

The Service, including software, branding, and documentation (excluding your User Content), is owned by AutoVisuals and its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted, these Terms do not grant you any license to our intellectual property.

DMCA and copyright concerns

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to [email protected] with the information typically required under the U.S. Digital Millennium Copyright Act (including identification of the copyrighted work, the allegedly infringing material, your contact details, a statement of good faith belief, and a statement of accuracy under penalty of perjury). We may remove or disable material in appropriate circumstances.

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOVISUALS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOVISUALS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO AUTOVISUALS FOR THE SERVICE DURING THE THREE (3) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). THE LIMITATIONS IN THIS SECTION APPLY TO ANY THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Indemnity

You will defend, indemnify, and hold harmless AutoVisuals and its affiliates from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or applicable law, except to the extent caused by AutoVisuals’ willful misconduct.

Termination; suspension

You may stop using the Service at any time. We may suspend or terminate access for conduct that risks the Service, other users, or legal compliance, or for extended inactivity where permitted. Provisions intended to survive termination (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law) will survive.

Governing law; disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, excluding its choice-of-law rules. Subject to applicable law, you and AutoVisuals consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for disputes arising out of these Terms or the Service.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

General

These Terms constitute the entire agreement between you and AutoVisuals regarding the Service and supersede prior discussions. If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

We may modify these Terms by posting an updated version and updating the “Last updated” date. If changes are material, we will take reasonable steps to notify you where we have contact information. Continued use after the effective date constitutes acceptance unless applicable law requires additional consent.
